General Terms and Conditions of Trade
1. Validity

(1) The following conditions apply to all sales, deliveries and services by grooves.land and the delivery partners within the scope of the grooves.land delivery offer. They apply unless otherwise agreed. The customer's terms and conditions apply only insofar as we expressly agree to them, otherwise you are hereby expressly rejected. Deviations from these terms and conditions only apply if we have confirmed them in writing.

(2) Consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its independent professional or commercial activity.

2. Conclusion of contract / offers

(1) The contractual partner is Ten Dance Media GmbH, acting under the name grooves.land.

(2) Various technical steps are necessary so that a contract can be concluded.
To buy an article from our range, you must first place the article in the shopping cart by clicking the "Add to shopping cart" button. You can then view your shopping cart ("shopping cart") or continue the ordering process by clicking on "checkout". You can then create a customer account ("create customer account"), log into an existing customer account ("log in") or order as a guest without creating an account ("go to checkout").
If you would like to order as a guest or would like to create a customer account, you must now enter all the necessary data that are necessary for the order. If you have already created a customer account, your invoice and delivery data are already stored. You will then see an overview of your entered shipping and billing address and your shipping options. Now you have to select a payment method and click on "Next" at the bottom right. After selecting the payment method, you will be able to check your order again on the next page. To complete the order, all you have to do is click the "Buy Now" button at the bottom right.

(3) The time of the conclusion of a purchase contract depends on the payment method you have chosen.
  • Payment in advance
    If you have chosen the payment method prepayment, placing our products on grooves.land is only a request to submit an offer by ordering the item. We will then send you an e-mail that confirms that we have received your order and lists its details (order confirmation). This order confirmation represents the acceptance of your offer and thus the time of the conclusion of the contract.
  • Paypal
    If you have chosen PayPal as the payment method, placing products on grooves.land is an offer from us and not an invitation to submit an offer on your part. The contract comes into effect the moment you accept grooves.land's offer by confirming the payment instruction to PayPal.
  • Instant bank transfer
    If you have selected the payment method SOFORT Überweisung, the contract is concluded at the time of confirmation of the payment instruction to SOFORT GmbH.
  • Credit card
    If you have selected payment by credit card as the payment method, the contract is only concluded when your credit card is charged.
  • direct debit (SEPA direct debit)
    If you have selected the direct debit payment method (also SEPA direct debit), the contract comes into effect at the time when your account is debited.
(4) The goods are only delivered in customary household quantities. We reserve the right to cancel orders from obvious resellers, especially for price promotions.

(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract is partially automated by e-mail. You must therefore ensure that the e-mail address you have stored with us is correct, the receipt of the e-mails is technically ensured and, in particular, is not prevented by SPAM filters.

3. Price

(1) The prices on the day of the order shown in the shopping cart apply. We reserve the right to change prices due to errors and technical errors. If the prices are incorrect, we will not send anything without the prior consent of the customer. All prices are calculated based on your location and selected destination. For deliveries within the European Union VAT is included.

(2) Unless otherwise stated, our prices are in euros. Special offers and free offers are subject to change. There is no entitlement to the continuation of offers. Special offers apply while stocks last. Free items can only be ordered once per customer, item and order.

(3) The shipping costs incurred are not included in the purchase price. They are shown separately in the course of the ordering process and are to be borne by you, unless delivery free of charge is promised.

(4) If the delivery is made to countries outside the European Union, we may incur additional costs for which we are not responsible, e.g. Customs duties, taxes, or money transfer fees (bank transfer or exchange rate fees) to be borne by you. You will also have to bear the costs of the money transfer in cases in which the delivery is made to an EU member state but the payment was initiated outside the European Union.

4. Terms of payment

(1) If payment is made in advance, the contract is concluded by sending the order confirmation by email. The purchase price is only payable by email when requested.

(2) When paying by direct debit, a debit from your bank account will only be made after the goods have been dispatched / after dispatch confirmation.

(3) Please note that not all payment options are always available to you. These depend on the type of order, the items ordered, your place of residence and possibly your shipping request.

(4) Credit check
If we make advance payments, e.g. If payment is made on account or direct debit, your data will be sent to creditPass, Mehlbeerenstr. 4, 82024 Taufkirchen, Germany to protect our legitimate interests for the purpose of credit checks based on mathematical-statistical procedures. We reserve the right to refuse you the payment method on account or direct debit as a result of the credit check.

5. Right of retention, retention of title

6. Warranty, notification of defects and compensation

7. Withdrawal from goodwill / refusal to accept

(1) Goods may only be returned if we have expressly asked for them in warranty cases or if we have exceptionally agreed to the return or an exchange in writing beforehand.

(2) For goods returned on the basis of return or exchange agreements that are not based on a warranty obligation on our part, we issue a credit according to the price list valid at the time the goods were returned. Any cash discount and purchase advantages used will be deducted. A cash payment of the credit amount is not possible. We are entitled to offset all claims against the purchaser, including those that are not yet due, against the purchaser's claim against us.

(3) We do not issue a credit for goods sent without authorization.

(4) All returned goods must be in a condition that also enables us to return them to our supplier.

(5) In principle, if the goods are not satisfied or goods already received from other suppliers, the ordered items cannot be returned to us.

(6) Should the goods delivered by us return to us with the postage "Not picked up or acceptance refused", the customer will be charged separately for the postage costs.

(7) After repeated delivery of the goods, collection is initiated against the customer. Any costs incurred for this are to be borne by the customer.

8. Place of jurisdiction and applicable law

(1) Place of jurisdiction is merchants
In business transactions with traders and with legal entities under public law, the place of jurisdiction for all legal disputes regarding these terms and conditions and individual contracts concluded under their validity, including bills of exchange and checks, is the registered office of Ten Dance Media GmbH (Berlin) agreed. In this case, we are also entitled to sue at the customer's registered office.

(2) Applicable law
These general terms and conditions are subject to the law of the Federal Republic of Germany for all business or other legal relationships within Germany, however, the UN sales law does not apply. In the case of international contracts or other legal relationships within the European Union, consumers can rely on a more favorable regulation of their home law in accordance with ROM I-VO. In this case, the more favorable norms of the regulations applicable in his usual place of residence take precedence over the law mentioned in this clause.

9. Advertising / use of customer data

The use of customer data collected by us for advertising purposes can be prohibited during the collection or at any time later. For the transmission of the prohibition, there are only transmission costs according to the basic tariffs and no costs for value-added service numbers.

10. Final provisions

(1) The German language is available for the conclusion of the contract.

(2) The contract text is not saved by the dealer after the contract is concluded and is not accessible to the customer. You can view your transactions and orders via "My Account" or print out the order data immediately after submitting the order.

(3) Content of the online offer
The author assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, which refer to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are fundamentally excluded, unless the author can prove that it was intentional or grossly negligent Is at fault. Battery disposal and retraction
Batteries may not be disposed in the normal domestic waste. As the end-consumer you are legally obliged to return used batteries respectively dispose them properly. For this you can drop off your used batteries at the public collecting points in your community or wherever appropriate batteries are sold. The used batteries you obtained from us can be returned to us free of charge or you can send them back to us with sufficient postage.
